McInnes Wilson Lawyers recently assisted a First Nations foundation (Foundation) secure charitable status and DGR endorsement from the Australian Charities and not-for-profits Commission (ACNC).

Our team played a crucial role in securing charitable registration and providing expert advice on the structure and establishment of the organisation.

McInnes Wilson Lawyers assisted the Foundation on all aspects of securing charitable registration including:

  • Establishing a company limited by guarantee and drafting of the Foundation’s constitution to align with its charitable objectives;
  • Preparation of the Foundation’s Business Plan and related policies including Financial Management Policy and Conflict of Interest Policy;
  • Assisting the Foundation to develop their grants program including drafting of application forms, eligibility criteria and grant deed;
  • Preparing the Foundation’s charity registration application for submission with the ACNC;
  • Responding to ACNC’s request for information regarding the Foundation’s objectives and activities; and
  • Providing general advice to the Foundation’s board on a range of charitable and company matters.
