Jack advised the company and represented them in negotiations with their insurer. This resulted in the insurer overturning their original decision, fully indemnifying the company and paying their complete legal costs in challenging the indemnity.

Jack's client inherited a long-tail recovery action for damage to commercial premises by contactors on a neighbouring property.

The insurer was very conscious of the ongoing cost and difficulties they had had to date in ascertaining who was responsible for the damage. Jack managed to identify the party quickly and efficiently, particularise his claim and identify the insurer for the recovery target. This resulted in the recovery of the entire damages indemnified by the insurer plus full interest and indemnity costs, meaning that the insurer recovered all of its outlays and more.

A catastrophic personal injury claim was brought forwards after a young worker in a construction incident suffered a brain injury.

outcome achieved

The case involved eight other defendants with damages in excess of $18million due to the young age of the worker and the significance of the injury, resulting in multiple cross-claims for indemnity. Jack’s insured was significantly exposed, but Jack still managed to secure an outcome for less than 5% of the overall settlement amount and ensure any adverse publicity for both the insured and insurer.
