The Applicant filed an objection to the Commissioner’s deemed assessments in respect of fringe benefits tax for each of the FBT years ended 31 March 2012 to 31 March 2019. The appeal concerned travel expenses incurred by the Applicant in respect of air travel of its field-non manual employees who could not be accommodated on the mainland. The total amount of fringe benefits tax in dispute was $13,014,296.

In dismissing the appeal, Logan J held that the travel expenses were not incurred in the course of gaining or producing assessable income and accordingly did not meet the “otherwise deductible” rule.
