Pierce assists clients who have a particular goal in mind that may not fit the traditional scope of family law settlements. He excels in working with client’s other trusted advisors, including accountants and financial planners to achieve results specifically tailored to the client.

Pierce’s view is that it is not sufficient to merely get the best result, but rather to achieve the best result delivered in a way that furthers the client’s financial and other goals. Communication is perhaps the most important skill for a family lawyer. Good communication can drastically reduce conflict and cost.

Where one party had fled to New Zealand prior to being served with Court documents, Pierce assisted the client with her communication, and enabled her to achieve a negotiated settlement in a situation where further litigation would have been complicated and expensive.

Pierce is frequently engaged to assist clients in reaching a “positive” settlement through negotiation without recourse to the Court. The vast majority of client’s are seeking to avoid conflict, and he seeks to pursue where appropriate an amicable settlement through considered and conciliatory communication.

The vast majority of family disputes will settle before reaching a final trial. For this reason, negotiation is a critical skill.

Where a matter had been running for two years prior to McInnes Wilson Lawyers involvement, and where Court documents had already been filed, Pierce negotiated final orders on the steps of Court, obtaining an excellent result and saving the client enormous costs. While the parties were fixated on percentages rather than outcomes, the matter couldn’t be solved. By being more flexible in negotiations the parties were able to achieve a tailored outcome.

Contested parenting matters

Parenting matters can be some of the most difficult and high stakes work a family lawyer can undertake. For this reason, it is imperative that the work is performed with expertise and executed accurately.

Where one party relocated to a regional centre with the two children after being served Court documents. Pierce applied to the Court for orders that the children return and live with the parent/client. Preparation is key in all litigated matters. Pierce built a sophisticated brief of evidence that convinced the Court to have the mother brought back to Brisbane and the children ordered to live with the client.

Binding financial arrangements

Work Undertaken

Pierce is frequently engaged to produce binding agreements between parties who are to get married (Prenuptial Agreements) and who are about to commence a de-facto relationship (Cohabitation Agreements).

Pierce has recently finalised a prenuptial agreement which recognised loans made to one party by their father, and ensured that those funds would be quarantined in any future property settlement.

In a second matter, he ensured that a future inheritance would be quarantined in any future property settlement.

Without these agreements, both the family loan and the inheritance would have been available in a future property division.
