The Government in the Mid-year Economic and Fiscal Outlook in December 2015 included a revelation that there would be cuts to subsidies on certain claims under the Aged Care Funding Instrument (ACFI) as well as higher penalties for aged care operators making false claims under the ACFI.

A report of one in eight ACFI claims being incorrect or false has led the Government to take action in the form of a fine of $10,800 per offence for operators making repeated false claims under the ACFI.

In addition to the fines, it is proposed that there will be new measures such as stronger auditing and system updates as well as further education for operators.

Whilst the changes do not have immediate effect (as they are subject to consultation and amending legislation) operators should be aware that they are looming.

Now is as good of a time as any for operators to undertake their own internal audit of claims that have been made under the ACFI to determine whether all claims are being correctly made by staff.
