Negative property pool available to divide as the parties’ tax liabilities were so significant. The husband had a significantly higher income than the client, who also had primary care of the children.

Montana achieved an outcome that saw the wife retain the family home with no liabilities. The husband was responsible for all of the parties’ joint tax liability, and as a result of the debts, this represented over 100% of the asset pool being retained by her client. Montana also entered into a child support agreement which saw her client receive more child support than the agency had assessed.
