Terry McCormick has a reputation as one of Queensland’s leading transport insurance litigation lawyers. He works closely with clients to ensure the objectives for claims management and resolution are met. Identified that other Insurers were necessary parties to a multi party claim. They were joined responsible entities to the loss of $8m.

On the facts, the contract between the Self Insured and the other party, could result in an unintended indemnity not contemplated by the Self Insured. This resultant indemnity, would entitle the Self Insured to renegotiate the contractual terms resulting in a more favourable long term income entitlement to the Self Insured. A short term loss, but a long term benefit.

Identified that for two international claimants an opportunity would eventuate for surveillance. They were claiming damages of $800k plus. As a result of appropriate instructions as to when and where to do the observations, the claims settled for $10k each.
