Patrick McGrath’s insurance skills place him at the forefront of his industry. He has played an integral role in many of Queensland’s high profile insurance litigation cases in the last 22 years. Since his admission to practice in 1993, Patrick has acted solely for insurance clients across all areas including CTP, public risk and workers compensation. Due to the changing face of injury litigation in Queensland in recent years, it is seen as a distinct advantage to have an active participation in and an understanding of each of these areas. Patrick is regularly required to consider and advise on the interplay between workers’ compensation legislation, compulsory third party motor vehicle legislation, the Personal Injuries Proceedings Act 2002 and the Civil Liability Act 2002.

Patrick’s experience is reflected in his role as a guest lecturer at the Queensland University of Technology Legal Practice course in the areas of Insurance Litigation.

Patrick’s understanding of, and experience in the interplay between the various Queensland statutory Insurance schemes, sees him regularly called upon by Insurer clients to advise on complex indemnity issues. For example, in Kings College v Allianz Insurance Australia Ltd, a complex question of indemnity arose between a Workers Compensation insurer and a Public Risk insurer. Acting for the Workers Compensation Insurer, Patrick successfully defended the matter such that the public risk insurer was required to indemnify.

Serra v Couran Cove Management Pty Ltd (2012) QSC 130, Patrick successfully defended an employees claim for damages against the employer, where the employee had been seriously assaulted by a co-worker.
