Glenn has been a Principal at McInnes Wilson Lawyers since 2006, specialising in insolvency, taxation and commercial litigation. He is noted for his practical and commercial approach to resolving disputes that are complex and sensitive.

Glenn specialises in advising distressed businesses in respect of restructuring, turnaround and insolvency strategies. Further, he advises government and taxpayers in relation to taxation disputes. He works closely with accountants, financial advisors and insolvency practitioners. He works with a wide range of clients from SME business owners through to top tier lenders and large Commonwealth Government departments.

Glenn has built a strong reputation in his industry and is a current committee member and former State Chairman and National Director of the Turnaround Management Association. His ‘no-nonsense’ approach has endeared him to numerous clients.

Turnaround and restructure of distressed business

Work Undertaken

Lead legal advisor in respect of the stabilisation, restructure and ultimate sale of a mining services company with a turnover exceeding $50 million. Winner of the Turnaround Management Association Queensland turnaround of the year award 2014.

Lead legal adviser to the persons responsible for the winding up of a managed investment scheme with a face value exceeding $100 million which involved a complex work out of multiple property and construction projects.

Successfully opposing ASIC action to cancel the Australian Financial Services Licence of a managed investment scheme with assests under management from time to time of up to $200 million. Orders were obtained for the scheme to be wound down by the responsible entity rather than by a receiver. Glenn advised in respect of the wind down where the overall return to creditors exceeded 80 cents in the dollar.

Work Undertaken

Acted for lenders in recovery of various secured properties and in litigation concerning the validity, priority and enforcement of securities, including: aged care facilities, high rise unit developments, commercial properties and businesses, hospitality and gaming businesses and farming operations. A recent example includes assisting a top tier lender recover a loan book with a value exceeding $100 million consisting of funds advanced to investors in a number of failed agricultural investment schemes.

Acted for the Commissioner of Taxation in High Court Proceedings to determine the personal liability of receivers and liquidators for taxation in respect of income earned or capital gains received post their appointment.
