Work Undertaken

Recently John assisted in the defence of a complex large loss general insurance matter which arose out of an accident occurring on a worksite. There were 3 sets of concurrent proceedings afoot in both the District Court of NSW and the Supreme Court of NSW, involving multiple parties, ongoing indemnity issues, and concurrent workers compensation proceedings. He was required to analyse consolidate numerous volumes of evidence, complicated by the Plaintiff’s inconsistent medical and employment histories and inaccurate worksite diaries, and advise his client of: the respective liabilities of each party to the proceedings, prospective cross-defendants, risk exposure and mitigation, and general claims strategy.

Work Undertaken

During his time working for a CTP insurer, John was successful in the early resolution of a claim that had complicated liability and medical issues. The matter was complex in that the evidence obtained did not support the claimant's version of events. The claimant alleged they had walked up the left side of a motorway off ramp, when the insured driver, traveling in the opposite direction towards the exit of the motorway, collided with the claimant. Upon investigation, John formed the opinion that the claimant's version of events were completely inconsistent with the objective evidence. John alerted the claimant's solicitor to these issues and was able to resolve the matter commercially, substantially mitigating potential loss.
