Spencer is a Special Counsel in the firm’s Commercial Litigation team, having represented clients in complex litigation from QCAT to the High Court of Australia. While his work is currently acting for some of the top Australian and international insurers and self-insureds, Spencer has also spent much of his career acting for private clients including high net worth individuals and small-medium enterprises in a wide range of commercial disputes and insolvency matters.

Spencer’s work focuses on professional indemnity, property damage, life insurance and product liability claims. In always striving to deliver high quality work for clients, Spencer has always tried to ensure client’s best interests are always considered and progressed. He prides himself on understanding a client’s needs and giving fulsome and timely advice and representation.

Spencer's client was being pressured by their franchisor for breaches of the franchise agreement, that had been perpetrated by their ex-partner to settle for an exorbitant amount of money.

Spencer challenged the nature of the breach, considered the alleged damages and talked the client through the issues. The client had been pressured to settle quickly, but Spencer provided reassurance, clarified the spurious nature of the claim, and encouraged a challenge to the demand. They were able to settle the dispute with the client leaving the franchise and paying a fraction of the alleged damages.

Spencer's client was in business with an intimidating partner who was actively attempting to exclude the client from the business and potentially exposing the client to disciplinary action due to breaches of pharmacy regulations committed by the partner, for which the client would be jointly liable if discovered.

Spencer instigated winding up proceedings for the company and leveraged a position whereby the client was paid out substantially higher than market value for their shares and removed from a toxic situation and commercial exposure. The client was able to go on to more profitable business relationships.

A claim was brought against the Spencer's client for vehicle damage, by a claimant (solicitor) who had hit the insured’s parked car.

Spencer was able to obtain summary judgment against the plaintiff and was awarded costs orders in excess of the amount claimed by the plaintiff against the client.
