Private Client
CTP Insurance
Client problem

The client faced a claim where a pedestrian alleged being struck from behind by an unidentified motor vehicle on the highway in the middle of the night, with their brother as an alleged witness.

outcome achieved

With Salvatore's assistance, the claim was denied on the basis that the injury mechanism was not consistent with being struck by a motor vehicle alongside evidence suggesting the plaintiff fabricated the accident after falling on the road.

Motor Accident Commission
CTP Insurance
Client problem

The client faced a claimant that attempted to initiate and bring a claim 19 years after the motor vehicle collision occurred.

outcome achieved

The plaintiff wished to commence proceedings in the District Court of SA for personal injuries allegedly sustained in a motor vehicle accident 19 years ago. With Salvatore's assistance the claim was denied because the plaintiff was the driver of the vehicle and not the passenger as alleged. Given the period of time since the accident, it was difficult to investigate and obtain evidence. Salvatore's client maintained denial and the plaintiff ultimately discontinued action, consenting to summary judgment to Salvatore's client before trial.

Motor Accident Commission
CTP Insurance
Client problem

The client faced a difficult and fraudulent 'minor impact' claim.

outcome achieved

The Court found in favour of Salvatore's client on the issue of minor impact, awarding the plaintiff just over $7,000.00 (despite claiming well over $100,000.00), with the plaintiff to pay his client's costs given the earlier-filed offer.

Private Client
Compensation
Client problem

The client was the victim of an attempted home invasion and suffered severe psychiatric illness as a result.

outcome achieved

Despite the absence of any physical injuries and the fact that the claim involved an ‘attempted’ home invasion that went wrong, Salvatore was able to successfully execute an informal resolution of the claim with the Crown and obtain compensation for his client that allowed her to seek much needed medical treatment, and compensate her for the loss of earnings she suffered during the period for which she could not work.

Private Client
Medical Negligence
Client problem

The client suffered a severed carotid artery during a routine procedure and almost died as a result.

outcome achieved

Salvatore was able to liaise and negotiate with the hospital in order to achieve a successful result for his client.
