Philip is a Special Counsel in the firm's Insurance team. He acts for large and well-regarded insurers with a primary focus on CTP claims, as well as complex psychiatric injuries..

Philip has diverse experience, having practised in large national firms and boutique firms. He has completed secondments with a number of major insurers for extended periods, providing valuable expertise to his clients. He assists clients with the management of insurance claims, including representing insurers in the Personal Injury Commission, as well as in the Local, District and Supreme Courts, and the NSW Court of Appeal.

Philip prides himself on providing pragmatic and meticulous advice to his clients. He cares about his clients and their needs, focusing on delivering the most effective outcome whilst also being a collegial and fair litigant.

Client problem

The client was issued with a Claims Assessment Service Award of Damages that contained a legal error.

outcome achieved

Philip advised the client on the Award of Damages in the Claims Assessment Resolution Service (CARS). He commenced administrative proceedings in the Supreme Court of New South Wales on the basis of a Judicial Review Application with respect to errors in the decision of the CARS Assessor.

The Court determined that the decision of the CARS Assessor did contain a legal error in line with the insurer’s position, and the matter was remitted back to CARS for a further Assessment Conference to determine damages. Philip’s client then settled the claim on favourable terms before a further CARS Assessment was held.

The client was faced with a claimant who began proceedings well after the relevant limitation period for the commencement of court proceedings had expired.

outcome achieved

Philip prepared the necessary documentation to argue that the Court should not accept the plaintiff’s explanation to commence Court proceedings out of time, with arguments focusing on the plaintiff having plenty of knowledge that should have made them aware of the relevant legislative provisions regarding the limitation period. The Court found in favour of Philip’s client and denied the plaintiff’s application.

The client was faced with an exaggerated claim for personal injury damages from a claimant with undisclosed pre-existing conditions.

outcome achieved

Philip made detailed arguments regarding the claimant’s pre-existing conditions and the effect this would have on the claimant’s award for damages. He also achieved a favourable assessment of damages from the CARS Assessor in the Claims Assessment Resolution Service.

The claimant did not accept the Award of Damages, believing the sum awarded to be below their expectations, and the matter proceeded to court. Philip defended the claim, and the matter subsequently resolved prior to the District Court Hearing – for the same amount originally awarded by the CARS Assessor.
