Keely is a commercial lawyer who is passionate about achieving excellent results for her clients.

Keely is a Principal of the firm’s Financial Lines team. She is passionate about law and insurance and believes that both are fundamental to the smooth operation of today’s society. Her passion, enthusiasm and knowledge have seen Keely recognised for her commercial, legal and insurance expertise.

Keely has advised Australian, American and European insurers, underwriting agencies and corporates for over 25 years. Her specialities involve financial lines and policy interpretation and application, with a particular focus on alternative dispute resolution and commercial, early effective outcomes, Australian financial service provider claims, policy interpretation and regulatory advice, medical malpractice, shareholder class actions and director, officer and management liability.

Keely advises insurers, self-insureds, and charitable organisations on sensitive and complex psychiatric claims. 

Keely Graham is frequently asked to draft or settle policy wordings and endorsements and to advise and act on policy response, including in respect of insurance fraud.

Clients particularly value and trust Keely’s commercial appreciation of the industry, business and the claims and her ability to quickly shut down claims often before they are litigated.

Client problem

One of the client’s policyholders was suspected of committing insurance fraud after her home and business were suspiciously burnt down.

outcome achieved

Keely obtained a successful judgment in favour of the insurer based on circumstantial evidence proving that the insured burnt down her home and business in order to claim insurance funds. See the decision of Worth v International Company of Hannover SE [2020] NSWSC 249 here.

One of the broker ARs failed to renew a number of policies despite claiming they had been renewed. 

outcome achieved

Keely liaised with the broker group and its insurer to make sure there were no gaps in cover going forward. She addressed claims that arose, including negotiating very commercial outcomes and then successfully undertook recovery actions to minimise losses.

Client problem

The client wanted to provide innovative medical management solutions to an Australian life and health insurance company’s customers and required assistance with the complex limits, rules and regulations.

outcome achieved

Keely liaised with the insurer on behalf of her client to reach agreements that complied with the complex requirements of Australian laws (and practice) for life insurance and health insurance and negotiated business practice requirements and contracts. This ensured the novel scheme could legally (and commercially) proceed.
