The successful expanding family business required an estate plan to deal with business and personal succession.

Jolynda worked collaboratively with the client’s accountants to prepare and implement an estate plan to achieve the client’s objectives on the exit of the business, incapacity or death. This involved consideration of various assets, including in companies, trusts, superannuation and personally held assets and consideration of business succession agreements.

An estate plan was required to deal with the client’s incapacity or death to ensure their estate planning objectives could be achieved. The client had assets in various jurisdictions (Australia and abroad), which made the estate plan more complicated.

Jolynda undertook careful consideration and collaboration with lawyers in other jurisdictions to ensure the client could make an informed decision and all appropriate documents were prepared to deal with the client’s affairs in the way they intended.

An interstate financial administrator appointment for an adult without capacity was not recognised by Queensland law. As a result, a Queensland appointment through the Queensland Civil and Administrative Tribunal (QCAT) was required to be able to deal with the adult’s affairs in Queensland.

outcome achieved

Jolynda successfully set out issues with the current legislation before QCAT and had the financial administrator appointed as an administrator in Queensland in order to deal with the adult’s affairs on the terms requested.
