James was able to negotiate directly with the other party, which resulted in the claim being resolved before the matter was required to go to mediation or a final hearing.

James' client had taken steps to terminate an employee's employment after receiving some complaints about this employee. The client believed that the employee was still on a probationary period as they had recently purchased the business. However, the relevant sections of the Fair Work Act with respect to the prior service of the employee had not been followed, and therefore the employee was not on a probationary period. The employee brought an unfair dismissal claim following their termination.

outcome achieved

James assisted the client in responding to the unfair dismissal claim, and then attended at the Conciliation Conference with the client. At the Conciliation Conference James was able to resolve the matter for an amount much less than may have been ordered at a final hearing, and without his client incurring substantial legal costs in defending the claim.

An ex-employee of Jame's client filed a sexual harassment and sex discrimination claim against his client stating that they were subjected to harassment and discrimination whilst employed.

outcome achieved

In this matter, James was able to directly negotiate with the employee's representative and resolve the matter prior to a mediation or final hearing. This resulted in the client confidentially resolving the matter without needing to outlay substantial legal costs in defending. Additionally, the matter was able to be resolved for a sum much less than may have been ordered at a final hearing.
