Trevor assisted the client with significant waste facility proposals. He successfully defeated the proposed development through a complex court appeal, with the court accepting all arguments advanced on behalf of the local government. This outcome protected nearby residents and the environment and has established a strong precedent for other waste facility proposals in the local government area.

The local government claimed payment of infrastructure charges five years after completion of development.

outcome achieved

The development was completed under two separate approvals, and infrastructure charges were mistakenly paid on one approval only. It had been sold to a third party, who received a claim for payment of infrastructure charges from the local government in the order of $8 million. Through a combination of negotiations and detailed submissions, Trevor resolved the matter for a significantly reduced payment – less than 25% of the amount initially claimed.

A flood levee had been designed following the 2011 flood events and had State and Federal government funding in place (contingent on completion timing). A local resident appealed construction of the critical piece of community infrastructure to the Planning and Environment Court, potentially delaying the project and risking the community through a further significant wet season forecast. The State and Federal government funding were also at risk due to strict timeframes in the funding agreements and competition for funds from other flood-affected communities.

outcome achieved

Trevor facilitated the call-in of the development application, which the Minister subsequently approved. From there, Trevor was able to promptly deliver a successful result for the community and ensure completion of the levee for flood immunity into the future.
